THE ISSUE OF LINKING COLLECTIVE LABOUR RIGHTS TO THE EXISTING CONCEPT OF ECONOMICALLY DEPENDENT PERSONS UNDER ZDR-1

The author discusses the appropriateness of using the concept of economically dependent person (under Slovenian law) as a basis for extending collective labour rights to a wider group of self-employed persons. The author concludes that the individual application of the concept of economically dependent persons under ZDR-1 is problematic in many respects. This problem becomes even more evident when it comes to the exercise of collective rights by a larger number of self-employed persons. In the event of extending the entitlement to collective labour rights to persons outside an employment relationship, linking this to the existing concept of an economically dependent person under ZDR-1 does not seem to be the optimal solution.
