Abstract

Property as a Parameter of Public Town Spaces' Planning in Socialism and Capitalism

In this article, we examine the relation of urban spaces planning, in a period of transition from capitalism to socialism, and the concept and forms of property in capitalism, in the legal system and the constitution of the former Yugoslavia as well as in the legal system of the Republic of Croatia. Split III, part of the city of Split, is a case study in two different social systems. The author finds that for public town spaces building purposes a collective property and crystallization of collective entities of public goods is necessary. Since a town presents a collective being, planning of public spaces needs to be equal to an individual’s autonomy and his property, and for the purposes of the town’s functioning, it even needs to be exceeded.

Lastnina kot dejavnik načrtovanja javnih mestnih prostorov v socializmu in kapitalizmu

V tem članku proučujemo povezanost načrtovanja javnih mestnih prostorov v obdobju tranzicije iz socializma v kapitalizem in pojem ter oblike lastnine v kapitalizmu, v pravnem sistemu in ustavi nekdanje Socialistične Federativne Republike Jugoslavije ter tudi v pravnem sistemu Republike Hrvaške. Split III, del mesta Split, je študijski primer v dveh različnih družbenih sistemih. Ugotavljamo, da je za potrebe gradnje javnih mestnih prostorov kristalizacija kolektivnih subjektov javnih dobrin skozi javno pravo nujna. Ker mesto predstavlja kolektivno življenje, mora biti načrtovanje javnih prostorov enakovredno avtonomiji posameznika in njegovi lastnini ter ju za določene potrebe funkcioniranja mesta kot celote tudi preseči.
