Slovenian and German Competition Policy Regimes: A comparative analysis

Abstract

We use an institutional approach to analyze differences and similarities between competition policy regimes in Slovenia and Germany. We first indicate differences that exist in the implementation of EU competition law at the national level, given the unified framework of EU competition policy. In a next step, we discuss recent cases in both countries and indicate how historical developments and economic factors influence decision making and case law. We also discuss recent developments of the national competition policy regimes and indicate how the digital economy might shape competition policy in the future.

Dr. Andreas Polk is a professor of economics at Berlin School of Economics and Law. His research focus is on industrial organization, competition policy, regulation and lobbying. Before he joined Berlin School of Economics and Law in 2008, he completed his doctoral thesis at the University of Zurich and gained practical experience as a case handler at the German competition authority (Bundeskartellamt). He publishes regularly in international peer-reviewed journals, works as an expert for energy market reform in Vietnam, and regularly teaches economics as a guest lecturer in international contexts.

Andreja Primec, PhD, graduated lawyer, is an associate professor in The Department for Business Law at the Faculty of Economics and Business, University of Maribor. She started her professional career at the High Court of Maribor. Her basic fields of professional and scientific research work are business law, international business law, European Union law, intellectual property law and arbitration law. She has published several scientific articles on these topics and participated in international scientific conferences in Slovenia and abroad.
