Effectivness of Legal Regulation of Proprietary Rights over Employee Created Inventions

Abstract

Article deals with the allocation of rights over employee created innovations. Ownership over employee created innovations can follow either principles of labour law or intellectual property law. In search of the balance between the two, the principle of efficiency has to be taken into account. The author estimates that the Slovenian legislator has only partly fulfilled this criterion and therefore suggests a change of legislation in pursuit of higher efficiency of legal rules. Special attention is given to the innovativeness at universities.

Učinkovitost pravne ureditve imetništva pravic iz inovacij, ustvarjenih v delovnem razmerju. Prispevek obravnava vprašanje alokacije pravic iz inovacij, ustvarjenih v delovnem razmerju. Imetništvo pravic iz inovacij, ustvarjenih v delovnem razmerju, lahko izhaja bodisi iz delovnopravnih bodisi iz intelektualnopravnih načel. V iskanju primernega ravnotežja med obema izhodiščema pa je treba upoštevati tudi načelo učinkovitosti. Avtorica ocenjuje, da je slovenski zakonodajalec ta kriterij le delno izpolnil, zato predlaga spremembe zakonodaje na tem področju v smeri večje učinkovitosti pravnih pravil. Avtorica posebno pozornost posveča tudi pravni ureditvi inovativnosti na univerzah.
